Hey Rafi AI, Inc. (“Hey Rafi,” “we,” “us,” or “our”) is committed to respecting your privacy.  This Privacy Policy explains our practices regarding the collection, use, and disclosure of information that you (“you” or “user”) may provide to us through your use of our website located at https://heyrafi.com/ and its sub-domains (the “Website“), the Hey Rafi web application platform and related subscription services (the “Platform”), our social media pages, and any other websites, products, or services that we link to this Privacy Policy (collectively, our “Services”). 

This Privacy Policy is incorporated into, and is part of, our Terms of Service available at heyrafi.com/terms-of-service/ which govern your access to and your use of the Services.  If you have entered into a separate agreement with us, that separate agreement shall control, and only those terms within this Privacy Policy that do not conflict with such separate agreement shall apply.  This Privacy Policy does not cover information we receive from third parties.  If you have any questions regarding this Privacy Policy, please contact us at [email protected].  

By accessing the Services, you agree to be bound by this Privacy Policy.  If you do not agree to the terms of this Privacy Policy, please do not use the Services.  Each time you use the Services, the current version of this Privacy Policy will apply. Accordingly, when you use the Services, you should check the date of this Privacy Policy (which appears at the top) and review any changes since you last reviewed the Privacy Policy.

Please note, if you are using the Platform on behalf of a Hey Rafi Customer (defined below), we process your information when you are acting in that capacity in accordance with our agreement with the Customer.  The Customer’s processing of your information is governed by the applicable Customer’s terms and privacy policy, not by this Privacy Policy.  For more information, see the “Platform” subsection below.   However, when using the Platform in your personal capacity, this Privacy Policy will apply. 

Information we collect

We collect two types of information from users of our Services: “Personal Information,” which is information that you provide that can be used to identify you (such as your name, email address, etc.), and “Aggregate Information,” which is information that cannot be used to identify you (such as frequency of visits to the Website, browser type, etc.).

INFORMATION YOU PROVIDE TO US

We collect Personal Information that you voluntarily provide to us when you use our Services.  For example, you may provide us with your contact information such as your email address, first name and last name, phone number, company name, the content of your communication, or other Personal Information when you choose to submit such information to us through email, an online form, or other method (such as contacting us through our “Contact Us” Website feature, or setting up a demo of our product).   

If you interact with us on social media, we may collect your social media profile information, your communications with us, and your communications and posts on our social media pages and forums.  If you utilize any of our chat or communications features, we will collect the content of your communications.

If you sign up for our newsletter or mailing list, we collect the information you submit and you are signing up to receive marketing and other communications from us. 

HEY RAFI PLATFORM 

Please note, most Personal Information we collect in connection with the Platform is collected on behalf of our customers and their affiliated users (e.g., real estate professionals and companies) (“Customers”) who use our Services. Generally, Personal Information collected through a Customer’s use of our Services is collected on behalf of that Customer which has independent use and access to it. Customers may download, retain, and use this information outside of Hey Rafi’s systems. For more information on how a specific Customer uses Personal Information, including information collected through the use of our Services, please refer to the Customer’s privacy policy or contact the Customer directly.

Account Information.  We collect Personal Information of users of the Platform to create an account.  This typically includes business contact-related information such as name, email address, phone number, mailing address.   

Use of the Platform.  Users may submit to the Platform, or cause the Platform to collect, various information, including Personal Information.  This typically includes non-Personal Information such as information relating to properties and property listings, but may also include Personal Information such as contact details of sales leads, real estate listing agents, brokers, owners, and other individuals associated with properties and property listings.  We generally collect and/or use this information on behalf of Customers.

Platform Communications.  The Platform stores information and data contained in all communications that occur on or through the Platform.  This includes communications directly between users, as well as communications with external parties facilitated via the Platform.  We generally collect and/or use this information on behalf of Customers.  Please note, Customers are solely responsible to provide all notice and obtain all consent necessary to facilitate their communications with individuals through the Platform, including but not limited to by phone call, text message, and email, which may be done by automated/automatic means. 

Call Recording.  The Platform may include functionality to make telephone calls.  When telephone calls are made by or through the Platform, the conversation is recorded through audio recording means, and a text transcript of the conversation may be generated.  Prior to such recording, all participants to the telephone call are provided notice of such recording.  If a participant does not consent to such recording, the participant may end the telephone call. We generally collect and/or use this information on behalf of Customers.

INFORMATION WE AUTOMATICALLY COLLECT 

When you use our Services we automatically receive and collect information from your device.  This information includes the following:

AGGREGATE INFORMATION COLLECTED

Aggregate Information is information that does not identify you.  Aggregate Information may be collected when you use our Services, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Aggregate Information remains.  We may collect, use, store, and transfer Aggregate Information without restriction.

COOKIES AND ANALYTICS

Like most websites, our Website may use “cookies.”  Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our Website.

HOW WE USE YOUR INFORMATION

How we share your information

Like most companies, we share information, including Personal Information, in certain circumstances with third parties through operation of our Services and our business.  Below we explain when that happens. 

Note that all data and information, including Personal Information, contained in a Customer’s account is shared with the applicable Customer and all users associated with the Customer, and as between Hey Rafi and the customer, the Customer controls all Customer data.

SERVICE PROVIDERS

We may transfer Personal Information to third parties for the purpose of providing the Services or operating our business.  For example, we may transfer your Personal Information to third-party service providers to assist with providing the Services and other services, and to communicate with you about current or future offerings. 

REQUIRED TRANSFERS

We may also transfer your Personal Information to third parties under the following circumstances: (i) to comply with a legal requirement, law, subpoena, judicial proceeding, court order, governmental request, or legal process; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, asset sale, financing, reorganization, liquidation or dissolution of Hey Rafi, including the evaluation thereof; (iv) when we believe it is necessary to protect the rights, property, or safety of Hey Rafi or other persons, or (v) as otherwise required or permitted by law, including any contractual obligations of Hey Rafi.

CUSTOMERS

We may collect certain information, including Personal Information, from third-party sources on behalf of our Customers.  When we do so, we may share all of the information and Personal Information that we collect in such contexts with the Customer(s) for which we collected it. 

AS DIRECTED BY YOU AND WITH YOUR CONSENT

Except as otherwise provided in this Privacy Policy, we share Personal Information with companies, organizations or individuals outside of Hey Rafi only at your direction or when we have your consent to do so.  


Children’s privacy

Our Services are not intended for use by children under the age of 18 and we do not knowingly collect Personal Information from children under the age of 18 in connection with the Services. 

Choices and Opting out 

Platform: Users of the Platform can delete or modify most Account information through functionality in the Platform. To make additional privacy-related requests, please contact us at [email protected].  Please note that we may deny requests in certain circumstances in accordance with applicable law, including for example, when we are required to retain information for legal or regulatory purposes.

Marketing Email:  If you no longer wish to receive our marketing and promotional communications, you may opt-out by following the instructions included in each communication.

SMS/MMS Text Messages:  If you do not wish to continue receiving SMS/MMS mobile messages from us, You can opt-out at any time, including by sending “STOP” in response to a text message, by emailing us at [email protected].  You are not required to consent as a condition of purchasing any property, goods, or services.

How Do We Protect Your Information

We take the security of your Personal Information very seriously.  We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us.  Despite these safeguards and our additional efforts to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information.

The Services may contain hyperlinks to websites operated by third parties, which may include social media features, such as LinkedIn buttons or links.  We provide such hyperlinks for your reference and convenience only.  We do not control such websites and are not responsible for their content or the privacy or other practices of such websites.  It is up to you to read and fully understand their Privacy Policies.  Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.  If you are submitting information to any such third-party through our Services, you should review and understand that party’s applicable policies, including their privacy policies, before providing your information to the third-party.
